法学教育的历史传统与时代转型——“新时代法治建设与法学教育”暨“时务学堂创建120周年纪念”学术论坛综述*

 

摘要:1897年创办的时务学堂作为湖南乃至中国近代法学教育的源头之一,其法律教学内容、教学模式、教学方式值得挖掘,也是新时代法学教育改革可资借鉴的样本。新中国法学教育取得重要成就,但存在注重理论教学、忽视实践教学和职业技能培养等问题。新时代给法学教育带来了教育资源共享、合作交流、国际接轨、人工智能等诸多机遇与便利的同时,也带来了诸多挑战。当下法学教育需要搭建理论教学与实践教学融合的培养平台,注重跨界式综合培养,积极回应新时代从技术到理念等多方面的挑战,适当借鉴国际上追求职业化、专业化、精英化的法学教育模式,回应社会热点,推动法学教育变革。

The Historical Tradition and the Transformation of Times of
Legal Education – Review of the Seminar of “the Construction of the Rule of Law in New Times” and “the 120th Anniversary of the Foundation of
Shiwu School of Hunan Province”

Abstract: Founded in 1897, Shiwu School was considered as one of the sources of Hunan Province and even China’s modern legal education. Some aspects of its legal education is still worthwhile to keep probing and studying, such as teaching content, teaching mode and teaching methods. It is also considered as one valuable referential example of the reform of legal education in the new times. Legal education after the foundation of new China has make great significances, but there are still some problems like overemphasizing theoretical teaching, neglecting practical training and professional capabilities cultivation. The new times brings legal education many opportunities and convenience, such as, the sharing of educational resources, cooperation and exchange, international communication, artificial intelligence and so on. However, it also brings many challenges as well. At present, contemporary legal education needs to construct a cultivation platform for the integration of theoretical teaching and practical training, which emphasizes the cultivation of comprehensive inter-disciplinary education and copes with such challenges from technology to new concepts in new times. It also needs to reference the international legal education mode of professionalism, specialties and meritocracy to respond the hot issues in community and promote the reform of legal education.
