法学硕士的交互教学模式探究——基于“学院式”和“学徒式”教育特色的分析

 

摘 要:当前中国法学硕士研究生教育存在着两大问题:实务教学流于形式与理论教学未深入真实的法律生态,而其根源在于缺乏理论与实务教学有效衔接互动的可操作模式。要克服这一理论与实践脱节的教学困境,需要将“学院式”教育与“学徒式”教育的长处相结合,优势互补。为此,具体可以采取“三重交互”的教学模式,即实践性交互教学方式、模拟式交互教学方式和研讨型交互教学方式,实现法学硕士研究生理论和实务教学在具体与抽象、个案与全局以及表层与深入三个层次上的有效互动。

On the Interactive Teaching Method of the Master of Laws - Based on the Analysis of “College” Education and “Apprentice” Education

Abstract: At present, there are two major problems in the education of the Master of Laws in China: the practical teaching falls into the formalities and the theoretical teaching does not probe into the actual situation of legal practices in society. The sources of the problems lie in the lack of an operable mode which can activate the effective interaction between theories and practices in teaching activities. In order to overcome this teaching dilemma of the disconnections between theories and practices, we need to combine "college" education with "apprentice" education together and make use of each other's advantages. To this end, the concrete measures can be done by way of using the “triple interaction” teaching mode, which means the practical interactive teaching mode, simulating interactive teaching mode and seminar interactive teaching mode. In this way, the effective interactions can be realized in the three levels of the concrete and abstract, cases and types, phenomena and deep discussions to achieve the legal education of the Master of Laws considering both theories and practices.
